Eligibility for social housing
Social housing staff can struggle with ‘recourse to public funds and immigration law’ as it impacts on their work. There is confusion and uncertainty about who is ‘eligible’, especially as the law, regulations and case law are always changing.
Every social landlord also has its own discretionary ‘exclusion’ policies for those guilty of ‘unacceptable behaviour’. As discretion increases in allocation, housing providers need to ensure their policies and procedures can withstand a legal challenge.
This training will provide clarity and point to best practice across all these issues.
You will learn:
- Who housing providers can and cannot house legally
- What questions to ask and what proof to request
- Up-to-date regulations and changes to right to reside, work, have recourse to public funds, etc
- Relevant recent case law
- How each social landlord can decide who is or is not caught by ‘unacceptable behaviour exclusions’
- How and when to ‘bend’ policies and procedure to fit
- New approaches as allocations become more about local discretion
- How to answer possible legal challenges.
Who should attend?
Everyone involved in prevention and/or actual homelessness, allocations, lettings, transfers, mutual exchanges including policy, procedure and strategic staff.
Richard Paris has an MA from Queens' College, Cambridge and a post-graduate Diploma in Housing from LSE. From 1991-93 he was senior research officer at LSE Housing, and has worked for short-life and supported housing agencies, mainstream housing associations and local authorities. He is a freelance housing law specialist with 20 years’ training and development experience undertaking educational training, consultancy, policy and procedure health checks. He specialises in housing law updates, dealing with anti-social behaviour effectively, preventing and controlling rent arrears, do-it-yourself possession proceedings, the law in supported housing and the law on disrepair and best practice.
